This course examines theoretical foundations and practical applications of adversarial and problem-solving approaches to negoti-ation, as well as effective advocacy in settlement conferences before judges and in mediations. Particular attention is paid to the differences between adversarial and problem-solving negoti-ations; techniques for identifying and advocating clients’ interests; ways to recognize, classify, and overcome impediments to settlement; and methods of preparation for successful negotiations, settlement conferences, and mediations. (No prequisite. Satisfies Intermediate Skills Requirement.)
