Comparative Criminal Procedure - LAW840

3 Credits

This course explores competing conceptions of due process through a survey of the American and Israeli systems of criminal procedure. Both American and Israeli systems inherit an English approach to criminal procedure that is basically adversarial in nature. However, the on-the-ground implementations of the adversarial process differ in key respects. This course considers how representative differences between the systems reflect practical and philosophical choices about the best ways to achieve procedural and substantive justice. (No prerequisite. Satisfies Perspective Requirement.)
