The course is designed to teach the New York rules of evidence that exist in criminal and civil courts. New York is unique in that the Federal rules of evidence do not apply in New York State courts. New York does not have codified rules of evidence for state courts. This class will teach students the New York rules of evidence and how they are applicable in the state courts. This course will present a comprehensive overview of evidence law, including relevancy, fungible and non-fungible evidence, foundations for the admissibility of evidence, hearsay, competency, direct examination and impeachment of witnesses, privileges, presumptions, and burdens of proof.
