In this course, students will explore criminal law and regulation of sexually based offenses. Topics will include rape (forcible and statutory), child sexual abuse, and sex trafficking, as well as technology-based offenses such as revenge porn and sextortion. This course aims to examine the nuanced statutes that criminalize sexual offenses, rationales for punishment, and the rapidly expanding areas of civil remedies for victims. Psychological theories and typologies on the development of sexual misconduct and pedophilia will be studied. Current developments in New York law will be explored, which includes an understanding of the unique issues facing prosecutors and defense attorneys, such as techniques in trauma-informed lawyering, preparing sexual assault victims for court, incorporating areas of scientific expertise (including DNA), rape shield laws, enhanced punishments for sexual offenders, and the sex offender registration act.
