Practicing Commercial Litigation - LAWN904

This course examines commercial litigation as a distinct field of legal practice. Drawing on the law pertaining to contracts, business organizations, fraud, torts, government regulation and specialized civil procedure, the course focuses on how these elements function together in real-world disputes before specialized courts, particularly the New York Commercial Division. Students will develop practical skills in case evaluation, litigation strategy, motion practice, and dispute resolution, while considering the ethical and collateral consequences of litigation. Although some portions of this course will entail lecture, the main purpose of this class will be accomplished by a series of simulations in which the student, over the course of the semester, will alternatively hold the role of Plaintiff and Defense Counsel.
